We don’t share your information with third parties except to deliver you our Services and products, comply with the law, make FERSAFE better, protect our rights, or effectuate a business transfer. We’re not a huge, faceless corporation. We’re just developers trying to deliver an incredible product. By using FERSAFE, including downloading one of our mobile applications or visiting our website, you agree to the use, disclosure, and procedures outlined in this Privacy Policy.

WHAT PERSONAL INFORMATION DO WE COLLECT FROM OUR USERS?

We do our best to minimize the amount of Personal Information that we collect from FERSAFE users. Your contact information, such as your phone number,, or email address (depending on how you contact us), may be collected when you communicate with us for support, or if you report a bug or other error related to FERSAFE or when you interact with us through social media. When you use our Services, we process PUBLIC wallet addresses that you generate through FERSAFE.

WILL WE SHARE YOUR PERSONAL DATA WITH THIRD PARTIES?

Information about our users is an important part of our business and we are not in the business of selling our users’ personal information to others. We may transfer personal data to our service providers or third parties in connection with FERSAFE’s operation of its business, as certain features on FERSAFE rely on various third-party products and services (collectively “Third Party Services”), . These third party services providers only have access to certain Personal Information, such as your public Wallet addresses, to perform their functions and may not use it for other purposes. Furthermore, they must process the personal information in accordance with our contractual agreements and only as permitted by applicable data protections laws. Business transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, user information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy notice (unless, of course, the user consents otherwise). Also, in the unlikely event that TrustWallet or substantially all of its assets are acquired, users' information will be one of the transferred assets. We may share non-personally identifiable information publicly and with our partners- like publishers, advertisers, developers, or right holders.

DATA SECURITY

We are committed to making sure your information is protected in accordance with applicable laws and our data privacy policies. We have selected third-party vendors that use the Ethereum network, including Coinbase, Shapeshift, and Changelly, that help us keep your Personal Information safe. Unfortunately, we do not control these third parties and therefore cannot guarantee complete security. We work to protect the security of your personal information during transmission by using encryption protocols and software. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your personal information and secure all connections with industry standard transport layer security. Even with all these precautions, we cannot fully guarantee against the access, disclosure, alteration, or deletion of data through events, including but not limited to hardware or software failure or unauthorized use. Any information that you provide to us is done so entirely at your own risk.

AGREEMENT TO TERMS

By accessing or using any or all of the Services, you expressly acknowledge that (i) you have read and understood these Terms; (ii) you agree to be bound by these Terms; and (iii) you are legally competent to enter into these Terms. If you do not agree to be bound by these Terms or any updates or modifications to these Terms, you may not access or use our Services. WE DO NOT PROVIDE INVESTMENT OR FINANCIAL ADVICE OR CONSULTING SERVICES. WE ARE SOLELY THE PROVIDER OF FERSAFE ANDWE DO NOT ADVISE OR MAKE RECOMMENDATIONS ABOUT ENGAGING IN DIGITAL ASSET TRANSACTIONS OR OPERATIONS. DECISIONS TO ENGAGE IN TRANSACTIONS OR PERFORM OPERATIONS INVOLVING DIGITAL ASSETS SHOULD BE TAKEN ON YOUR OWN ACCORD.

ELIGIBILITY

To be eligible to use FERSAFE: (i) you must be at least eighteen (18) years old and legally competent to enter into these Terms; (ii) you must not be a resident of sanctioned jurisdictions according to any trade embargoes, UN Security Council Resolutions (“UNSCR”) or HM Treasury's financial sanctions regime; and (iii) you must not be currently the subject of or subject to economic sanctions such as the United Nations Security Council Sanctions List, the list of specially designated nationals maintained by OFAC, the denied persons or entity list of the U.S. Department of Commerce or any similar list maintained by any other relevant sanctions authority. If you are using our Services on behalf of a legal entity, you further represent and warrant that: (iv) the legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization; and (v) you are duly authorized by such legal entity to act on its behalf. You can only use our Services if permitted under the laws of your jurisdiction. For the avoidance of doubt, you may not use our Services if you are located in, or a citizen or resident of any state, country, territory or other jurisdiction where your use of our Services would be illegal or otherwise violate any applicable laws. Please make sure that these Terms are in compliance with all laws, rules, and regulations that apply to you. You agree that you are only using our Services with legally-obtained funds that rightfully belong to you. By using FERSAFE, you represent and warrant that you meet all eligibility requirements that we outline in these Terms. We may still refuse to let certain people access or use FERSAFE, however, and we reserve the right to change our eligibility criteria at any time.

WALLET REGISTRATION AND SECURITY

You must either import or create a wallet in order to use FERSAFE. When you create a wallet, you will be assigned a Secret Phrase. You agree to immediately notify us of any unauthorized use of your Secret Phrase or any other breach of security of your wallet. You acknowledge and agree that you shall assume all risks related to the use of the Services and you shall be solely responsible for maintaining the confidentiality and security of your Secret Phrase. When you create a wallet, you are strongly advised to take precautions in order to avoid loss of access to and/or control over your wallet. Suggested measures include, but are not limited to, the following: (a) creating a strong unique password that you do not use for any other purpose (i.e. different to your phone password or any other passwords you use for websites, online services, etc.) (b) do not store the Secret Phrase in plain text online or in an unsecured physical location; (c) limiting access to your devices and your wallet; (d) taking all necessary precautions against malware on your devices and networks; and (e) promptly notifying us if you discover or otherwise suspect any security breaches related to your wallet. We shall have no liability whatsoever in connection with activities that occur on your wallet with or without your authorization.

Transaction Fees

There may be transaction fees (e.g. mining fees) associated with your virtual currency transactions that are required by the virtual currency system or blockchain network that you engage with. You must ensure that you have an adequate balance in your wallet and/or “gas” to complete transactions before initiating a transaction. You acknowledge and agree that we will not be liable for any failed transactions or losses you incur due to incorrectly set transaction fees (i.e. too low or too high) or due to insufficient funds or gas associated with your wallet address. You further acknowledge and agree that we do not have access to your or anyone else’s transactions.
